In a blow to the West Bengal police the Chief Judicial Magistrate, Darjeeling District Court yesterday quashed their earlier order proclaiming Bimal Gurung and Roshan Giri as “proclaimed offender.”
On the 24th of June, 2019 the Darjeeling District Court had issued a “Proclaimed Offender” notice against Bimal Gurung and Roshan Giri – citing that “despite Warrant Pending Arrest (WPA) issued in their name, the arrests are still pending. They haven’t surrendered in court either.”
Following this Advocate Anand Bhandari had challenged the notice on their behalf.
Today, the order passed by the Chief Judicial Magistrate dated 24-06-2019 declaring Bimal Gurung and Roshan Giri of Gorkha Janmukti Morcha as proclaimed offenders was recalled.
Corresponding with the Press, Mr. Bhandari said, “The Ld court held that the Investigating Officer of the court never intimated the Court regarding the proceedings in the SC and the subsequent filing of the petitions for anticipatory bail in the High Court. Hence the accused cannot be said to be avoiding this Court.”
Mr. Bhandari added, “meanwhile, the Writ petition filed by the rebel Commissioners” of the recently dissolved Board of Councillors of Darjeeling Municipality challenging such dissolution before the Circuit Bench of Calcutta High Court is slated to be heard in the next Circuit.”
It may be recalled that Darjeeling Police had done widespread postering and publicity of the “proclaimed offender” notice earlier.
